Terms of Service

1. Acceptance of Terms

By accessing and using Meetup ("Service"), you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. The Service is operated by Meetup and is available as a web application and progressive web app (PWA).

2. Description of Service

Meetup is an event coordination and scheduling platform that allows users to:

  • Create and manage events with proposed time slots
  • Collect availability from participants
  • Integrate with external calendars (Google Calendar, Apple Calendar, Outlook)
  • Create video conference meetings (Zoom, Google Meet)
  • Send invitations and notifications via email
  • Organize event activities (Secret Santa, potluck signups, menus, and more)

3. User Accounts and Registration

You may use certain features of the Service without an account. However, to access full functionality, you must create an account by:

  • Providing a valid email address and password, or
  • Signing in through Google or GitHub OAuth

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate information and keep it current. You must be at least 13 years of age to create an account.

4. Subscription Plans and Billing

The Service offers both free and paid subscription tiers:

Free Tier

  • Create up to 3 active events
  • Maximum 10 attendees per event
  • Basic event features

Pro Subscription

  • Unlimited events and attendees
  • Calendar integrations (Google, Apple, Outlook)
  • Video conferencing integration (Zoom, Google Meet)
  • Custom invitations and branding
  • Waitlist management
  • CSV data export
  • Event tools (Secret Santa, potluck, menus, and more)

Billing Terms

Pro subscriptions are billed monthly or annually through Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. You may cancel your subscription at any time through your account settings or the Stripe billing portal. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial billing periods.

5. Third-Party Services and Integrations

The Service integrates with third-party services to provide enhanced functionality. By using these integrations, you agree to the terms and privacy policies of these providers:

  • Google: Calendar access, Google Meet, and Google Sign-In (subject to Google's Terms of Service)
  • Microsoft: Outlook Calendar integration (subject to Microsoft's Terms of Service)
  • Apple: Apple Calendar integration via iCloud (subject to Apple's Terms)
  • Zoom: Video meeting creation (subject to Zoom's Terms of Service)
  • Stripe: Payment processing (subject to Stripe's Terms of Service)
  • Unsplash: Background images for invitations (subject to Unsplash's Terms)

We are not responsible for the operation, availability, or policies of third-party services. You grant us permission to access your connected accounts only to provide the requested functionality.

6. Calendar Access and Data

When you connect a calendar integration, you authorize the Service to:

  • Read your calendar events to check for scheduling conflicts
  • Create calendar events when you confirm attendance at an event
  • Access only the calendars you explicitly select

Calendar data is accessed in real-time and is not permanently stored on our servers, except for the connection tokens required to maintain access. You may disconnect calendar integrations at any time.

7. Event Creation and User Content

You retain ownership of all content you create, including event titles, descriptions, custom invitations, and uploaded images. By posting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content solely for the purpose of operating the Service.

You agree not to create events or content that:

  • Violates any applicable laws or regulations
  • Infringes on intellectual property rights
  • Contains false, misleading, or deceptive information
  • Promotes hate, violence, discrimination, or harassment
  • Contains spam, malware, or malicious content
  • Violates the privacy of others

7A. Chat Feature and Messaging Conduct

The Service provides real-time chat functionality for event participants. By using the chat feature, you agree to:

Acceptable Use

  • Communicate respectfully with other event participants
  • Keep conversations relevant to the event
  • Not share personal information of others without their consent
  • Not use the chat to harass, bully, or intimidate others
  • Not send spam, advertisements, or solicitations
  • Not share inappropriate, explicit, or offensive content
  • Not impersonate other users or misrepresent your identity

Message Visibility and Retention

  • All chat messages are visible to event participants
  • Messages are stored as part of the event data
  • Event organizers can view and delete any message
  • Deleted messages show as "Message deleted" to other participants
  • Messages are retained until the event is deleted

Reporting and Moderation

  • You may report messages that violate these terms
  • Messages receiving multiple reports may be automatically hidden
  • Event organizers serve as primary moderators for their events
  • We reserve the right to remove content and suspend accounts that violate these terms
  • False or abusive reporting may result in account suspension

No Expectation of Privacy

Chat messages are not private communications. All messages are visible to event participants and may be accessed by event organizers for moderation purposes. Do not share sensitive personal information, financial details, or confidential data in event chats.

8. Attendee Data and Visibility

When you participate in an event:

  • Your name and availability will be visible to all event participants
  • Your profile photo (if set) may be displayed on the event page
  • Event creators can see additional information such as email addresses for waitlisted users and RSVP status
  • Event creators with Pro subscriptions may export attendee data as CSV files

By participating in events, you consent to this information being shared with other participants and event creators.

9. Email Communications

By using the Service, you may receive transactional emails including:

  • Account verification and security notifications
  • Event confirmations and updates
  • RSVP notifications
  • Invitations sent by event creators
  • Waitlist promotions

You may manage your email notification preferences in your account settings. Note that certain transactional emails (such as security and account-related notifications) cannot be disabled.

10. Prohibited Activities

You agree not to:

  • Use automated systems, bots, or scrapers to access the Service
  • Attempt to interfere with or compromise system security
  • Circumvent usage limits or subscription restrictions
  • Collect personal information from other users without consent
  • Impersonate others or misrepresent your identity
  • Use the Service to send spam or unsolicited communications
  • Violate rate limits on email verification or other features

11. Account Termination

We may suspend or terminate your account immediately, without prior notice, if you breach these Terms or engage in activities harmful to the Service or other users. You may delete your account at any time through your account settings.

Upon termination:

  • Your access to the Service will cease immediately
  • Events you created will remain accessible to participants unless deleted
  • Your personal data will be handled according to our Privacy Policy
  • No refunds will be provided for unused subscription periods

12. Intellectual Property

The Service, including its original content, features, and functionality, is owned by Meetup and is protected by international copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without explicit permission.

13. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. WE DO NOT GUARANTEE THE ACCURACY OR RELIABILITY OF THIRD-PARTY INTEGRATIONS OR CALENDAR DATA.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEETUP AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE, THIRD-PARTY INTEGRATIONS, OR SUBSCRIPTION SERVICES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

15. Indemnification

You agree to indemnify, defend, and hold harmless Meetup and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

16. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms with a new "Last updated" date. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

17. Governing Law and Disputes

These Terms shall be governed by the laws of the State of California, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, except that either party may seek injunctive relief in court for violations of intellectual property rights.

18. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
